Omake Rewards Program Terms and Conditions
These Rewards Terms govern your participation in Merchant loyalty programs facilitated through the Omake App. They supplement the Application Terms, Digital Card Terms, and Privacy Policy. If they conflict with the Application Terms on program mechanics, these Rewards Terms prevail.
1. Definitions
Omake / Kouvre / we means Kouvre Inc., a technology provider based in Montreal, Quebec, operating the Omake wallet. Member means a registered diner. Merchant means an independent restaurant using Omake. Points means digital loyalty points for a Merchant. Stamps means visit-based marks toward a stamp goal. Voucher means a reward that staff validate at the counter. Rewards Milestone means a Merchant offer redeemable for Points, Stamps, or a Voucher.
2. Independent programs
Each Merchant runs its own program. Points and stamps earned at one Merchant cannot be transferred or redeemed at another. Kouvre is the technology platform only. The underlying balances and rewards are the Merchant's responsibility. We are not liable if a Merchant fails to honour a reward or leaves the App.
3. Earning
3.1 Points. Unless a Merchant sets another rate, Members earn one hundred (100) Points per one dollar ($1.00 CAD) of eligible spend. Merchants may set their own rates.
3.2 Stamps. A Merchant may award one stamp per eligible visit, subject to a minimum spend, a minimum interval, and a stamp goal shown in the App.
3.3 Eligible visits. Earn happens on in-store purchases when staff scan your diner QR before payment is finished. Amounts are the bill the Merchant records. Earn is not awarded retroactively. Delivery orders are not awarded unless the Merchant enables them.
3.4 One scan. One staff scan can feed every active program at that Merchant (points and stamps).
4. Redeeming
4.1 Catalogues. Merchants set their own Rewards Milestones and stamp rewards, including random rewards from a catalogue.
4.2 Vouchers. Redeeming issues a voucher with a code and QR. Staff must validate it at the Merchant. Vouchers expire on the date shown in the App.
4.3 No cash value. Points, stamps, and vouchers have no cash value, cannot be exchanged for money, and cannot be sold or transferred to another account.
5. Expiry and inactivity
5.1 No time-only expiry for points. Under the Consumer Protection Act (Quebec), Points do not expire solely because time has passed.
5.2 Inactivity. A Merchant may expire Points or deactivate a program card after twelve (12) consecutive months with no earn or redeem at that Merchant. We will send written notice 30 to 60 days before that date.
5.3 Vouchers. Issued vouchers expire on their stated date even if the underlying points would not.
6. Program changes
If a Merchant changes an earning ratio, we will adjust existing balances so relative value is not reduced. If a redemption cost increases, existing Members keep the prior rate until their next redemption at that Merchant; new Members use the new rate. Material detrimental changes will be notified at least sixty (60) days in advance, with a right to refuse or cancel participation, as required by Quebec consumer law.
7. Merchant withdrawal
If a Merchant closes, becomes insolvent, or leaves Omake, balances at that Merchant may become unredeemable. We will try to notify you in the App. Kouvre has no duty to compensate those balances.
